Washington DC – -(AmmoLand.com)- When we discussed financial de-platforming, we noted that for the firearms industry – in fact, even for those who want to buy firearms – access to financial services, including banking is a must. If access to those services are denied, say through a re-started Operation Choke Point, then the Second Amendment becomes a dead letter.

But now, Representative Carolyn Maloney (D-NY) wants to require people to show proof of insurance to be able to buy a firearm. She introduced HR 1004 with one co-sponsor, Representative Andre Carson (D-IN). While text of this bill is not available as of this writing, Representative Maloney has introduced this bill in the 116th and 115th Congresses as the Firearm Risk Protection Act.

The text of the legislation as introduced in the 115th Congress states that it is unlawful to buy a firearm without a “qualified liability insurance policy” and that it is also illegal to sell to someone without said “qualified liability insurance policy.” Now, the definition the text provides is vague, beyond saying that the policy should provide “liability insurance covering the purchaser specifically for losses resulting from use of the firearm while it is owned by the purchaser.”

It is not an overstatement to say that Second Amendment supporters can figure out just what sorts of mischief can take place. Operation Choke Point is just the start. Given the constant social stigmatization surrounding not just the exercise of Second Amendment rights, but against those who use the First Amendment to advocate in defense of our Second Amendment rights, some insurance agents may not want the business at all. In addition, there is no guarantee that insurance companies won’t engage in a form of “redlining” against certain firearms.
Even if those things don’t happen, the insurance is going to be yet another monthly expense for those exercising our Second Amendment rights. Even then, there would be questions: Would a new gun require an adjustment in the policy? Would rates go up for those with larger collections? The list goes on and on.
This legislation is not intended to address any problems with the misuse of firearms – or even accidents. What it is intended to do is to make exercising Second Amendment rights such a hassle people will decide to give them up. Second Amendment supporters should contact their Representatives and Senators and politely urge their opposition this legislation. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

Congress – -(AmmoLand.com)- When discussing legislation, like HR 127 or HR 880, there are two terms Second Amendment supporters should be well aware of: Sponsorship and Co-Sponsorship. Knowing these terms can actually help inform our activism.

Many times, lawmakers will say they support our rights. The easiest way to tell is looking at their voting record. They have to vote “Yea” or “Nay” on a given piece of legislation or an amendment, and that vote is public record – it’s hard to run away from. But there is a part of the public record that often isn’t covered as much by the media: Who sponsors and co-sponsors legislation.

Sponsorship and co-sponsorship can be a very big tell for Second Amendment supporters. It’s what separates a member of the legislature who does the bare minimum from someone who is willing to be a leader in the fight to defend our Second Amendment rights. It can also reveal who is not being forthright when they claim to support our rights.

Now, this is not to condemn those who vote the right way on legislation or to diminish their support. There can be many reasons someone doesn’t often sponsor or co-sponsor legislation.  Perhaps their positions are more a rejection of anti-Second Amendment extremism than wanting to push back laws. They may have real questions about a given piece of legislation. Maybe there is a lot of anti-Second Amendment extremist activism in their district. There may even have been a horrific crime or act of madness involving firearms in the recent past. As a general rule, member of Congress or your state legislature who votes the right way should be given the benefit of the doubt.
Sponsorship
The member of Congress or a state legislature who introduces a piece of legislation is known as the sponsor. They can be considered to be the primary proponent of that given legislative item – be it a bill or resolution. Someone sponsoring pro-Second Amendment legislation, like the Home Defense and Competitive Shooting Act can rightly be seen as a leader, and that sort of move is something to be considered when you are weighing your vote should they seek higher office. On the flip side, someone who sponsors anti-Second Amendment legislation can be seen as a leader for the other side.
Co-Sponsorship
The real tell, though, can be something called co-sponsorship. This is a way for many lawmakers to express their support for legislation that has been introduced, and often the media doesn’t tell you who co-sponsors legislation involving your Second Amendment rights.
Tracking co-sponsorship of legislation can do a lot of things. It can tell you how much support there is for a given piece of legislation. Sheila Jackson Lee’s HR 127, the Sabika Sheikh Firearms Licensing and Registration Act, for instance, has ZERO co-sponsors as of this writing, so it can be seen as something too extreme for a number of anti-Second Amendment extremists.
It also can tell you who is being forthright about their Second Amendment support. Is your lawmaker co-sponsoring a lot of pro-Second Amendment pieces of legislation? That’s a good sign they are solid supporters. On the flip side, a lawmaker who sponsors some anti-Second Amendment legislation while claiming to back gun rights needs to face some tough questions.
Knowing about sponsorship and co-sponsorship can give Second Amendment supporters a good idea of where things stand. Always be in touch with your elected officials to politely urge their support for our rights, and don’t forget to support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the anti-Second Amendment elected officials are defeated at the ballot box as soon as possible.

Addressing Financial De-Platforming A Must
United States/Your Neighborhood – -(AmmoLand.com)- Second Amendment supporters need to understand why many anti-Second Amendment extremists are targeting banks and financial service companies – because our Achilles heel is not so much government action, it’s the money. Sound crazy? Not really. Throughout history, exercising our right to keep and bear arms has always involved money.

Think about the guns you own. In many cases you bought the firearms, either new or used. But at some point, somebody needed to acquire them from the FFL, who acquired them from the business that manufactured them or the business who imported them from a foreign country, where somebody manufactured them. This is true for every firearm that us privately owned (or owned by a federal, state, or local government), even for the ones you inherited from your parents (or other relatives).

This is why the push for corporate gun control is so dangerous. Take, for instance, the action Salesforce announced in 2019. Banks and financial service companies, in particular, can have a massive impact on our rights – and we presently have few options should there be a concerted effort. Part of the fight will involve passing state-level legislation to prohibit discrimination against the firearms industry and Second Amendment advocacy groups.

But we can’t just fight in the legislative and political arena. In this case, voting with our wallets – not to mention our 401(k)s, IRAs, and other accounts – is just as important. Loyalty cannot be a one-way street. If a bank or insurance company is taking fire for refusing to bow down to extreme anti-Second Amendment agenda, we need to back them with our business and support to the greatest extent possible.
In some ways, those who seek to inflict injustice upon us make it easy: The same year Salesforce made its pronouncement, one anti-Second Amendment group began a pressure campaign to boycott banks it viewed as too Second Amendment-friendly. So, we have a starting point on that basis.
As important as contacting your Representatives and Senators and politely urging their support of the Second Amendment and supporting the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible are, this alone is not going to protect our rights over the long term.
The fact of the matter is that the fight for the Second Amendment has become a full-spectrum conflict. The boardroom and cubicle have now become places where our Second Amendment rights are debated and acted on. Given today’s climate, Second Amendment supporters who are in that arena will have some tough calls to make – if open advocacy is not an option, they can always contact the team at Ammoland to blow the whistle on plans to attack our rights.

Below The Radar – HR 880 amend the Consumer Product Safety Act

United States – -(AmmoLand.com)- As we noted with the re-introduction of the Sabika Sheikh Firearms Licensing and Registration Act as HR 127, bad bills often turn up in Congress after Congress. But Sheila Jackson Lee is not the only member of the House of Representatives bringing back a bad bill. Chicago’s Robin Kelly is, too, and her terrible idea is far more likely to be passed into law than HR 127.

In the 116th Congress, Kelly introduced the Firearm Safety Act of 2019, which placed firearms under the Consumer Product Safety Commission. It’s back as HR 880, and the problems it had when it was reviewed last year are still there. There is, of course, the fact that it hands massive powers over our Second Amendment rights to unelected, unaccountable bureaucrats.

In some ways, this is worse than “stroke of the pen, law of the land.” Executive orders can be undone by a President. The D.C. bureaucracy, though, is an entirely different matter, especially when it comes to their edicts. Presidents have a much harder time undoing them. Imagine, for instance, if anti-Second Amendment extremists try to use the CPSC’s reporting process to claim popular firearms like the AR-15 and Glock are unsafe – trying to trigger an involuntary recall.

Could Second Amendment supporters count on the courts to halt this gun ban by bureaucratic fiat? You may want to think twice about that assumption. The harsh truth is that the courts may not stop such an effort. For instance, despite the Protection of Lawful Commerce in Arms Act, lawsuits against the manufacturer of the guns used in the Sandy Hook shooting on dubious grounds have been allowed to proceed, even though the guns used in that horrific shooting were stolen. If courts can find a way to ignore a law, then they could easily ratify a dubious recall, especially if the bureaucracy involved takes pains to follow its “normal” procedures.
The best way to avoid the abuse of this power by unelected and unaccountable bureaucrats at CPSC is to make sure that the power is never given to that agency in the first place. Second Amendment supporters should contact their Representatives and Senators and politely urge their opposition this legislation. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

United States – -(AmmoLand.com)- Representative Sheila Jackson Lee has not been a friend of law-abiding gun owners – or anyone who values the Second Amendment. If anything, she has been very active, and has introduced some of the most onerous proposals we have seen. But like Dianne Feinstein in the last Congress, she is not averse to more modest bills to unjustly punish those who seek to exercise their Second Amendment rights for horrific acts they did not commit.

In this case, her fallback is HR 125, the Gun Safety: Not Sorry Act. Rather than a sweeping licensing and registration scheme that is deeply intrusive, it instead imposes a one-week waiting period for any semiautomatic firearm, many standard magazines (like those for a Glock 17), suppressors, and “armor-piercing ammo.”

Now, we’ve discussed the waiting period scam before. Put your thoughts about the tactics used to limit the damage done by the Brady Act in 1993 aside. Suffice it to say, when the national instant background check system (NICS) is up and running, there is no justification for a waiting period. If a person is no prohibited, they should be able to take their purchase home with them the moment NICS reports it is a legal transaction.

The fact is, most handguns sold today are semiautos and many of those semi-autos have magazines that normally hold more than 10 rounds. The commonality of the latter is such that a federal judge threw out California’s magazine ban citing the simple text from the Heller decision that commonly-owned firearms are protected – a decision a Ninth Circuit panel has upheld. So, Sheila Jackson Lee wants to make you wait for the type of firearm that is most likely to be useful for self-protection. (Not that revolvers are bad guns, per se, or ineffective, but semiautos have taken the lion’s share for perfectly valid reasons.)
Now, if you want to keep bad guys from getting guns, the waiting period is, at best, superfluous. The fact is, instant checks can deny the purchase, and if there are federal, state, or local authorities who are serious about enforcing laws regarding attempts by those prohibited from owning firearms to obtain them, there are ways to actually arrest and prosecute them. So what is the real purpose of the waiting period? It’s not to solve the purported problem Representative Jackson Lee claims to be addressing.
Second Amendment supporters should contact their Representatives and Senators and politely urge their opposition to this unjust bill, and ask that they instead support legislation like the Protecting Communities and Preserving the Second Amendment Act, which actually addresses the misuse of firearms and does not infringe on our rights. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

What Bills Would Reflect Biden’s Agenda?

United States – -(AmmoLand.com)- When Joe Biden called for law-abiding Americans to be punished for a horrific act that they didn’t commit this past Sunday, exploiting the third anniversary of the Parkland school shooting, he didn’t name any specifics. Now, it goes without saying that we know the truth about the cowards of Broward County. We know who deserves the blame, and it isn’t those who have been exercising their First Amendment rights to defend the Second Amendment.

His demands were general ones, the usual nonsense about a semiauto and magazine ban, plus universal background checks. He also demanded that Congress open the door for unelected trial lawyers to pressure firearms manufacturers into complying with the demands of anti-Second Amendment extremists. But the devil is often in the details, and the place to find those details are in legislation. Ammoland has coverage of some of the legislation that covers Biden’s demands – or variations on the theme.

Background Checks
Text for a universal background check bill introduced in the 117th Congress is not available via the Congressional web site as of this writing, although Breitbart News reports Chris Murphy has already introduced a bull in the Senate. However, there have been other bills that have sought to make the National Instant Check System far more onerous than it already is. One of the most notable covered in Ammoland is the Background Check Completion Act of 2020.

That bill would make a fundamental change to the principle of NICS by eliminating the three-business-day limit that applies when a firearms transaction is delayed. In essence, that delay becomes a way to deny without actually denying and triggering the appeals process. Another possible bill whose provisions could be snuck in is the NICS Review Act, which would allow for the retention of records on legal firearms transactions.
Semi-Auto Bans
While we similarly have no legislation introduced for a semiauto or magazine ban in this Congress as of this writing, there are two bills introduced this Congress that do have some special targeting of modern multi-purpose semiautomatic firearms. One is HR 127, the Sabika Sheikh Firearms Licensing and Registration Act, introduced by Sheila Jackson-Lee, who also introduced HR 125, the Gun Safety: Not Sorry Act. HR 125 forces a seven-day waiting period on semiauto firearms, standard magazines, and other accessories. Now, in the last Congress, we saw a number of semiauto bans, notably Eric Swalwell’s outright ban and “mandatory buy-back.”
Empowering Trial Lawyers To Bypass Democracy Attack The Second Amendment
Perhaps the most dangerous part of the Biden agenda is the plan to let trial lawyers attack the Second Amendment. In the late 1990s, many big-city mayors were willing to join with anti-Second Amendment extremists to sue gun manufacturers to force them to accept an anti-Second Amendment agenda. It was a democracy bypass. Outright repeal legislation for the 117th Congress is not available yet, but there is legislation that enables another democracy bypass – handing power to regulate firearms to unelected bureaucrats. HR 880, a revived version of a bill we covered in the previous Congress, is already pending.
The Biden agenda to punish us for a horrific act we did not commit can be stopped. Second Amendment supporters should contact their Representatives and Senators and politely urge their opposition to Biden’s demands, and to instead support legislation like the Protecting Communities and Preserving the Second Amendment Act, which actually addresses the misuse of firearms and does not infringe on our rights. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

Below The Radar – Gun Violence Reduction Resources Act of 2021

United States – -(AmmoLand.com)- While a lot of attention is rightfully being paid to the threat posed by HR 127, the Sabika Sheikh Firearm Licensing and Registration Act that we have covered earlier this month and in the last Congress, there are other bills targeting our Second Amendment rights. As of this writing, a search for the term “firearm” under legislation in the 117th Congress reveals 29 entries.

Not all of them are massive assaults on our rights. Some are relatively minor, or they seem neutral but the lead sponsor of the legislation means that they require significant scrutiny. One such bill is HR 121, the Gun Violence Reduction Resources Act of 2021. The lead sponsor is Representative Sheila Jackson-Lee, who also introduced HR 127.

According to the text of the legislation, the bill seeks to add 200 agents and investigators to the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Now, that in and of itself is not necessarily a bad thing. The problem is just how these agents will be used. 200 ATF agents, in the right places, could make a big difference in the violent crimes we see in cities like Chicago and Baltimore.

The problem is that Representative Jackson-Lee doesn’t intend for some common-sense ideas for how to use those agents, like following up on arrests of violent criminals in possession of firearms and using the provisions of 18 USC 922 and 18 USC 924 to get some lengthy prison terms for them.
Let’s just look at a few from 18 USC 922:
18 USC 922(a)(6) makes it a federal crime to make any false statement or to present a false ID to a FFL. Penalty: 10 years in prison.
18 USC 922(d) makes it a federal crime to provide a felon a firearm. Penalty: 10 years in prison.
18 USC 922(g) makes it a federal crime for a felon to possess a firearm. Penalty: 10 years in prison.
Then there are these provisions from 18 USC 924:
18 USC 924(b) provides for a 10-year sentence to ship, transport, or receive a firearm in interstate or foreign commerce if they know or have reason to believe a felony would be committed in that transaction.
18 USC 942(h) provides for a 10-year sentence for anyone who provides a firearm knowing or having reason to believe it will be used in a crime of violence or drug-related crime.

In the findings, she mentions how many are killed, but doesn’t discuss the problem of violent criminals. Instead, the bill claims, “Millions of guns are sold every year in “no questions asked,” transactions and experts estimate that 40 percent of guns now sold in the United States are sold without a background check of the purchaser.”

In other words, these agents will be sent, often on wild goose chases, harassing FFLs who, in all likelihood, followed the law and did nothing wrong. The actual violators of the law won’t be touched – and there are significant provisions that could work to address those who run guns to violent criminals. Those provisions have been around for a long time and could work.
So, in the scheme of things, HR 121 is not a bill Second Amendment supporters should back. Instead, they should contact their Representatives and Senators and politely urge their opposition to this bill, and to instead support legislation like the Protecting Communities and Preserving the Second Amendment Act, which actually addresses the misuse of firearms and does not infringe on our rights. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

Winning In 2022 And 2024 Requires A Coalition

United States – -(AmmoLand.com)- If there is one lesson that we should take from some recent events, it is that removing anti-Second Amendment extremism from the levers of power at the federal, state, and local level is going to require a lot of work. Part of that work will involve building bridges, often to those who are most affected by the failures we have seen anti-Second Amendment extremists use their calls to attack our rights to distract their ill-served constituents.

Can anyone look at the state of affairs in cities like Chicago and Baltimore, and say that the onerous restrictions on Second Amendment rights passed by Illinois and Maryland have done anything positive for the citizens of those cities? The track records of failures are obvious – and are something that should be the focal point of many campaigns by Second Amendment supporters.

While the same anti-Second Amendment extremists push bills like the Sabika Sheikh Firearm Licensing and Registration Act, they are often allowing violent crime to run rampant, while refusing to enforce laws already on the books that would make a massive difference. For all the complaints some raised about Project Exile, it served Second Amendment supporters well on two fronts: It not only blunted the push for new gun laws, more importantly, it made people safer by taking bad guys off the streets.

As things stand in America right now, there is the chance for Second Amendment supporters to build a short-term coalition based around anti-anti-Second Amendment extremism. This is not a typo. What this means is that Second Amendment supporters should work to get a large number of Americans who either don’t have strong positions on Second Amendment issues, or who have let other issues override their support for the Second Amendment on board with opposition to the excesses of Eric Swalwell, Sheila Jackson Lee, and other anti-Second Amendment extremists.
By simply highlighting the failure to enforce laws of the books centering on the misuse of firearms in violent crime, or for drug trafficking, or even “gun-running,” Second Amendment supporters have the opportunity to gain enough non-opposition in the suburbs and in urban areas to carry statewide elections. One of the biggest reasons is that anti-Second Amendment extremists are all caught up in the latest fads from academia, and not in the real common-sense solutions.
Passing legislation like the Protecting Communities and Preserving the Second Amendment Act and the Restoring The Armed Career Criminal Act at the state level – and pushing for passage at the federal level – would be the first steps to securing improvements like the Freedom Financing Act, the Firearms Interstate Commerce Reform Act, the Home Defense and Competitive Shooting Act, and the FOPA improvements Senator Daines introduced at the state and federal levels.
This will take a lot of work, but it may be worth doing. In addition to building those bridges, Second Amendment supporters need to support pro-Second Amendment legislative and political efforts, including the NRA’s Institute for Legislative Action and Political Victory Fund.

United States Congress – -(AmmoLand.com)- One sad reality of some of the most extreme anti-Second Amendment legislation is that it will come back in Congress after Congress as long as its sponsor is still out there. The Sabika Sheikh Firearm Licensing and Registration Act is one of these bills.

This legislation was introduced last year in the 116th Congress and covered in Ammoland. It was part of a package of three bills introduced by Representative Sheila Jackson-Lee – the other two being the Santa Fe High School Victims Act and the Kimberly Vaughan Firearms Safe Storage Act. This year, it is labeled under HR 127, as opposed to being HR 4801 in the last Congress.

As you can imagine, this Congress’s iteration of the Sabika Sheikh Firearm Licensing and Registration Act is no less onerous and oppressive as its predecessor. If anything, though, some of the provisions now carry new menace given the constant calls for “deprogramming” we hear from pundits and cable “news” outlets of a certain persuasion.

Like its iteration in the last Congress, HR 127 calls for a psychological evaluation of those who wish to exercise their Second Amendment rights. Our past coverage noted that the evaluation could take a lot of time, given the number of interviews that would have to be scheduled. The concern then was the creation of more tragedies along the line of Carol Bowne, who was murdered by an abusive ex.
Now, however, given the desire for “deprogramming,” we could very well see the psychological evaluation used to target those who dissent from anti-Second Amendment extremism, who raise questions about certain issues, or who even supported former President Trump on other issues. After all, we haven’t ever seen government bureaucrats abuse power for political ends before, and even raising that notion might be enough to warrant “deprogramming” these days. After all, to believe some people, Second Amendment advocacy is domestic terrorism.
In addition, the climate of media-fueled hate adds another danger – the registration data is going to be made available to the general public. Someone can look up just how many firearms you own, what types of guns you have. It’s not just a massive planning aid to would-be thieves, but in an era of social stigmatization, it opens the door to discrimination and blacklisting across a number of areas, including employment and housing.
This bill is even more unacceptable now than it was when it was introduced in the last Congress. Second Amendment supporters need to contact their Representative and Senators and politely urge them to oppose this massive infringement that only punishes the law-abiding and to instead support legislation like the School Violence Prevention and Mitigation Act of 2019 and the Protecting Communities and Preserving the Second Amendment Act, which actually address school security and the misuse of firearms and do not infringe on our rights. Second Amendment supporters should also support the NRA’s Institute for Legislative Action and Political Victory Fund to ensure that the current anti-Second Amendment regimes in the House, Senate, and White House are defeated at the ballot box as soon as possible.

Washington DC – -(AmmoLand.com)- The decision by Senators Kyrsten Sinema and Joe Manchin to keep the legislative filibuster has given Second Amendment supporters something they desperately needed: Time. The next two years will be critical, both to shift the Senate landscape and to also regain the House.

Sinema and Manchin are not the most reliable of champions. In 2018, we noted that Martha McSally was a better choice as compared to the former. The latter could have been replaced by West Virginia Attorney General Pat Morrissey. Those two races, and the failure to beat Jon Tester loom large now. Had we won, it would mean control the Senate stayed in GOP hands, and it would have been a massive check on the Biden-Harris regime.

That is not the case, though. But by keeping the filibuster, it means the Supreme Court keeps its sure 5-4 majority on Second Amendment cases (6-3 if Roberts wants to influence who writes the rulings). That means there is a chance for key Second Amendment cases, like the Duncan case, to reach the Supreme Court, and shift that landscape in our favor.

This also will halt some of the worst legislative efforts, like campaign “reform” legislation that really has silencing opposition to anti-Second Amendment politicians and legislation as its aim. Again, we have just seen that our chances of taking back Congress from those who would steal our freedoms have improved.
But more importantly, it gives us time to win a lot of the local and state elections that will dictate the course of the 2024 presidential election. These state and local races matter big-time, and in many cases, they take much less effort to win than a congressional race, much less some of the statewide races.
Here, though, is the most important thing that Second Amendment supporters now have time to do: They have time to have those conversations that can change people’s minds about Second Amendment issues. The Biden-Harris regime is, as many predicted, governing in a manner to please the most extreme elements – and this is a chance for Second Amendment supporters to capitalize on this.
The fact that we are confronting what has to be the most hostile regime to our Second Amendment rights in America’s history require we step up. To build strength for the 2021 off-year elections and 2022 midterms that will shape future elections, Second Amendment supporters should support the NRA’s Institute for Legislative Action and Political Victory Fund.
